UAE Unemployment Insurance – Eligibility and ILOE Process. The UAE Involuntary Loss of Employment (ILOE) insurance scheme is a mandatory program designed to provide financial support to employees in the event of job loss. This scheme offers a safety net for both public and private sector employees, ensuring that they receive cash benefits during periods of unemployment. Understanding the eligibility criteria, documentation requirements, and claiming process is crucial for employees to successfully navigate this system.

To qualify for ILOE benefits, employees must meet several key criteria:

  1. Subscription Period: Employees must be subscribed to the unemployment insurance scheme for a minimum of 12 consecutive months without interruptions exceeding three months.
  2. Timely Premium Payments: All insurance premium payments must be made on time.
  3. Reason for Unemployment: The job loss must not be due to resignation. The termination must be clearly documented in the employer’s letter and the Ministry of Human Resources and Emiratisation (MOHRE) work permit cancellation application. This documentation is crucial as a resignation disqualifies an employee from receiving benefits.
  4. Non-disciplinary Dismissal: The employee must not have been dismissed for disciplinary reasons according to the laws governing labor relations in the private sector and human resources in the federal government.
  5. Timely Claim Submission: The claim must be submitted within 30 days of job termination or the resolution of any labor disputes referred to the judiciary.
  6. Absence of Active Complaints: The insured worker should not have any active complaints related to absenteeism or absconding.
  7. Honesty in Claims: Claims involving fraud or deceit will be disqualified. Additionally, if the employer is found to be fictitious, compensation will not be granted.
  8. Non-involvement in Strikes: The job loss should not result from participation in non-peaceful labor strikes or stoppages.
  9. Legal Presence in UAE: The employee must be legally present in the UAE at the time of filing the claim.
  10. Exclusions: Claims will not be considered if the job loss results from:
    • War or civil disorder.
    • Discharges of pollutants or nuclear events.
    • Biological or chemical pollution related to terrorism.
    • Government actions leading to expropriation or insolvency.
    • Force majeure as defined by UAE law.

To initiate a claim, employees must ensure that their labor contract is officially canceled by their employer. This process involves several steps and the submission of various documents:

    • Dismissal document indicating the date and reason for unemployment.
    • Emirates ID copy.
    • Certificate of insurance copy.
    • Work permit cancellation document.
    • Visa cancellation document.
    • Copy of the employment contract.
    • IBAN certificate.
    • Valid UAE mobile number.
    • Additional supporting documents as required, particularly in cases of labor disputes.
  3. Processing Timeline: Dubai Insurance Company, representing the insurance pool, will process the claim and, if approved, will transfer the payment to the insured’s designated account within two weeks.

Once a claim is submitted, the insurer will review the documentation. If all requirements are met, ILOE will request a ‘travel report’ to verify the employee’s presence in the UAE. This report, detailing entry and exit movements, must be generated before the visa cancellation. It can be obtained through the General Directorate of Residency and Foreigners Affairs (GDRFA) or Amer centers and uploaded via the Dubai NOW app under the ‘Travel’ category.
